Yes, you can downgrade to 3.1.2 but you cannot unlock it at this time. Just wait 1-2 more months.

You can unlock 3.1.3 now on a 3GS – just not on a 3G.
Go to http://Answernode.com and then select the iPhone section. Once you’ve done that download the (free) software.
There is a version for Mac and for PC – so pick the right one. (Both are free.) Then follow the step by guide
I did it like 2 days ago for my sister’s new iPhone, after she killed her old one in the toilet. (I was quite disturbed.)
